TurfBros Job Cost Reporting
This End-User License Agreement ("Agreement") is a legal agreement between you ("User," "you," or "your") and Eco Home Improvements Corporation, a California corporation doing business as TurfBros ("Company," "we," "us," or "our"), governing your use of the software application known as TurfBros Job Cost Reporting (the "Application").
By accessing or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the Application.
The Application is an internal business tool developed by and for the Company. Access is restricted to authorized employees, contractors, and personnel of the Company acting on its behalf in the course of their duties ("Authorized Users"). The Application is not licensed, distributed, or made available to the general public, to Company customers, or to any third parties.
Subject to the terms of this Agreement, the Company grants Authorized Users a non-exclusive, non-transferable, revocable, limited license to access and use the Application solely for internal Company business purposes, including reporting on job costs, customers, and related accounting data sourced from the Company's QuickBooks Online account.

The Application integrates with Intuit's QuickBooks Online ("QBO") platform on a read-only basis to retrieve the Company's accounting data, including but not limited to customer records, sub-customer records, job-related costs, and associated transactional entries. All data accessed through the Application originates from the Company's own QBO company file. The Application does not write to, modify, or alter QBO records.
Use of QBO data within the Application is subject to the Company's Privacy Policy and to Intuit's applicable terms and policies governing the QuickBooks Online platform.
The Application, including all software, code, designs, interfaces, documentation, and related materials, is the exclusive property of Eco Home Improvements Corporation and is protected by United States and international intellectual property laws. Nothing in this Agreement transfers any ownership rights to you.
The Application and all data accessed through it, including financial, customer, and job cost data, are confidential and proprietary to the Company. You agree to maintain the confidentiality of all such information and to use it solely in connection with your authorized duties for the Company. Your confidentiality obligations under this Agreement supplement, and do not replace, any separate confidentiality or employment agreement you have with the Company.
This Agreement and your license to use the Application terminate automatically upon any of the following:
Upon termination, you must immediately cease all use of the Application and return or destroy any Company data in your possession derived from the Application.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APPLICATION.
This Agreement is governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
The Company may update this Agreement from time to time. The updated version will be posted at the URL where this Agreement is published, with a revised Effective Date. Continued use of the Application after such changes constitutes acceptance of the updated Agreement.
